AnnA Boat Charters - Terms & Conditions

Purpose

The purpose of the Terms & Conditions for the yacht charter services provided by Anna Boat Charters is to establish clear guidelines and expectations for both the charter company and the clients. These Terms & Conditions serve several key purposes:

  1. Define Responsibilities and Liabilities:
    • Clarify the responsibilities of both the charter company and the clients regarding the use and care of the yacht and its equipment.
    • Outline the liabilities in case of damage, loss, or accidents during the charter period.
  2. Detail Payment and Cancellation Policies:
    • Specify the payment terms, including deposit requirements, final payment deadlines, and acceptable payment methods.
    • Define the cancellation policy, including any applicable fees and refund conditions.
  3. Ensure Legal Compliance:
    • Ensure that all activities are in compliance with relevant maritime laws and regulations.
    • Protect the charter company from legal disputes by clearly outlining the legal obligations of both parties.
  4. Enhance Safety and Security:
    • Set forth safety protocols and emergency procedures to be followed by clients.
    • Inform clients about the safety equipment on board and its proper use.
  5. Provide Operational Guidelines:
    • Detail the operational rules for using the yacht, including navigation limits, fuel usage, and prohibited activities.
    • Specify the check-in and check-out procedures, as well as the handling of personal belongings and waste management.
  6. Promote Transparency and Trust:
    • Build trust with clients by being transparent about the terms of service.
    • Ensure clients understand their rights and obligations, leading to a smoother and more enjoyable charter experience.
  7. Protect Company Assets:
    • Safeguard the yacht and its equipment by setting clear guidelines for their use and maintenance.
    • Minimize the risk of damage or misuse through explicit instructions and expectations.


By clearly articulating these terms, Anna Boat Charters aims to provide a professional, safe, and enjoyable experience for all parties involved.

Booking Policy - Sailing Holidays

To secure a yacht charter with Anna Boat Charters, clients are required to adhere to the following booking policy:

Reservation and Deposit: A reservation for a sailing holiday is confirmed upon receipt of a deposit amounting to 50% of the total charter fee. This deposit must be paid within seven (7) days of the booking confirmation to hold the reservation. 

Final Payment: The remaining balance of the charter fee must be paid no later than thirty (30) days before the commencement of the charter. For bookings made within thirty (30) days of the charter start date, the full charter fee is payable at the time of booking.

Security Deposit: A security deposit is required and must be paid prior to embarkation. This deposit is held against any potential loss or damage to the yacht and its equipment. 

If payments are not processed by the above mentioned respective due dates, AnnA Boat Charters reserves the right, without any liability, to cancel the booking & charter the yacht to a third party.

Payment Methods: Payments can be made via bank transfer or Paypal services, which also include online payments with credit and debit card. All payment details will be provided upon confirmation of the booking.

Cancellation Policy:

Should the charter be cancelled by Client, whatever the reasons may be, the Client shall be liable to inform AnnA Boat Charters per email about the cancellation without delay. Client shall be charged as follows:

  • Cancellations by the Client:
    • If the client cancels the booking more than thirty (30) days before the charter start date, the deposit will be refunded minus an administrative fee of 10% of the total charter fee.
    • For cancellations made between thirty (30) and fifteen (15) days before the charter start date, 50% of the total charter fee will be charged.
    • Cancellations made within fourteen (14) days of the charter start date will result in the forfeiture of the entire charter fee.
    • In case of no-show or early termination of the charter, no refund will be provided.
  • Cancellations by Anna Boat Charters: In the unlikely event that Anna Boat Charters cancels the booking, a full refund of all received payments will be issued. Alternatively, customers may choose to reschedule the charter to a mutually agreed-upon date. Please note that Anna Boat Charters’ responsibility ends with refunding the charter fee, and no further claims for compensation can be made.


Amendments to Bookings:
Any amendments to the booking, including changes to the charter dates or optional services, are subject to availability and may incur additional charges. All amendment requests must be made in writing and confirmed by Anna Boat Charters.

By adhering to these booking terms, clients can ensure a smooth and transparent process, allowing them to enjoy their charter experience with confidence and peace of mind.

Booking Policy - Day Trips

To secure a yacht charter with Anna Boat Charters, clients are required to adhere to the following booking policy:

Reservation and Payment: Booking pages for day trips will only be possible maximum 1 month in advance. At time of booking the full charter fee has to be paid within 7 days to confirm your booking. If your booking is made within 7 days of the charter date, the payment is due immediately. 

Security Deposit: A security deposit is required and must be paid prior to embarkation. This deposit is held against any potential loss or damage to the yacht and its equipment. 

If payments are not processed by the above mentioned respective due dates, AnnA Boat Charters reserves the right, without any liability, to cancel the booking & charter the yacht to a third party.

Charter Price - Sailing Holidays

General:

The price for Sailing Holidays is in Euro, includes the applicable VAT rate and is subject to change without prior notice.

Sailing Holiday price includes:

  • Skipper services for the duration of the charter
  • the vessel equipped according to the presently effective inventory-list
  • usual charter base services at the time of the charter start date (check in/check out)
  • mooring fees for the first & last charter night at our charter base in Paralio Astros

Charter price does not include:

  • any additional applicable tax
  • provisioning, food & beverages
  • Skipper’s meals
  • Hostess/Deckhand services & meals
  • Fuel / water consumption
  • Mooring fees
  • Canal fees
  • Transfer services
  • Optional excursions or activities
  • Any other additional services other than those explicitly stated as included in vessel’s equipment list.

If the yacht charter starts and/or ends in an alternative base (any base other than Paralio Astros, which is the homeport of the Vessel) the Client acknowledges that any berthing fees of the alternative base (marina) are not included in the charter price, and that the Client will need to settle the corresponding berthing fees in the alternative base, in addition to a one-way fee. This one-way fee will be calculated at €3,00 per nautical mile sailing distance from or to the home port, applicable VAT to be added.

Additional Services & Extras:

Request for additional services and extra equipment (hereinafter: Extras)  for which an additional cost will be added to the charter fee,  should be requested by Client during the booking process. Client may ask for addition of certain Extras even after the booking confirmation, and AnnA Boat Charters will undertake reasonable effort to provide the newly requested Extras to the satisfaction of Client, and will inform the Client if it is possible to upgrade the booking with requested new Extras or not. Client acknowledges that AnnA Boat Charters is not obliged to provide newly requested Extras at that point in time. At the latest, all Extras must be confirmed by both sides in writing not later than 10 days prior to the beginning of the charter date.

Mandatory & optional extras added after the booking confirmation are payable at base in cash, prior to embarkation. In case a credit card will be used for the payment of the extras, any extra fees will be paid by the card holder.

Security Deposit:

For all Sailing Holidays, cover against damage or loss to the yacht and her equipment is required.

  • For this purpose a sum of €500,00 will be charged, to be received by AnnA Boat Charters prior to embarkation. Payment can be done either by bank transfer 7 days before start of charter, or in cash at base during check-in.
  • After the completion of yacht charter the whole Deposit shall be returned to the Client, unless some Vessel damages or loss of equipment have occurred, or unless the Client has not acted in accordance with these Terms. However, if the damages or breach of these Terms have occurred, then Deposit will be retained partly or fully, depending on size of the damage or breach:
    • In case of a larger damage or breach, Deposit shall be kept in full, and Client has no right for refund.
    • In case of a smaller damage or breach, AnnA Boat Charters will keep the amount needed for the repairs and purchase of damaged or lost equipment, covering of intervention costs, plus €100 of handling costs, while the rest of the Deposit shall be returned to Client.
    • In case the Vessel will not be capable to go to next charter due to the incurred damages, always the full Deposit shall be taken, due to the fact that AnnA Boat Charters shall have expenses related to remunerating the next client.
    • In case the damage has happened due to gross negligence of the Client, or behaviours such as excessive alcohol consumption or illegal drugs, unauthorized use of Vessel, or similar serious breaches of these Terms, the Client shall be liable even beyond the amount of the Deposit, including expenses connected to repairs and remunerations for lost charter income in the next weeks. In such cases the Client is liable to cover those expenses without delay, and latest within 30 days from the end of the charter period.
    • In case of lost equipment, the Client is liable to AnnA Boat Charters for the full price of the lost items. These must be paid within 7 days from the end of the charter period.
    • In case of a blocked toilet, an amount of €250 will immediately be taken from the deposit
  • The Security Deposit applies per accident/incident (damage / loss). In case an incident occurs, in order to be covered against a 2nd incident, the charterer must replenish the security deposit to the initial amount. The new deposit is refundable in the end of the charter in case of no damages, losses, or breaches. In any other case, the charter agreement may be terminated.

AnnA Boat Charters reserves the right not to accept payment of Security Deposit in cash (for example: for one-way charters)

Charter Price - Day Trips

General:

The price for Day Trips is in Euro, includes the applicable VAT rate and is subject to change without prior notice.

Day Trip price includes:

  • Skipper services for the duration of the excursion
  • the vessel equipped according to the presently effective inventory-list
  • usual charter base services at the time of the charter start date (check in/check out)
  • mooring fees at our charter base in Paralio Astros
  • Full water tank
  • Engine fuel consumption
  • For day trips on the sailing catamaran we also include:
    • a light lunch and snacks
    • Hostess/deckhand (mandatory)

Day Trip price does not include:

  • any additional applicable tax
  • food (exception for day trip on sailing catamaran, see list above)
  • Beverages – honesty bar basis
  • canal fees
  • transfer services
  • optional excursions or activities
  • any other additional services other than those explicitly stated as included in vessel’s equipment list.

If the Day Trip starts and/or ends in an alternative base (any base other than Paralio Astros, which is the homeport of the Vessel) the Client acknowledges that any applicable berthing fees of the alternative base (marina) are not included in the price, and that the Client will need to settle the corresponding berthing fees in the alternative base. In addition a one-way fee or base change fee will be charged:

  • for the motorboat excursions as per Price List at time of booking (to be slected in the booking form)
  • for the sailing catamaran cruise the fee will be calculated at €3,00 per nautical mile sailing distance from or to the home port, applicable VAT to be added

    • Applicable only for the sailing catamaran: In case of a blocked toilet, an amount of €250 will immediately be taken from the deposit

Risk of Yacht Use & Insurance

Client accepts risks for all possible damages which can arise to the Client, guests and/or passengers during the Yacht Charter. In particular, Client waives each and every responsibility of AnnA Boat Charters, for situations such as possible accidents and injuries of the Client, guests and/or passengers, regardless of the reason of their occurrence, as well as any possible damages on the Client’s, guests’ and/or passengers’ personal belongings, as well as the situations when the belongings are missing or lost, either during the Yacht charter or after the Yacht check-out.

Our Vessel has been hull insured and has the appropriate insurance policies against damage towards persons and against damage towards third parties. The insurance does not cover damages of Client’s personal property and property brought to the Vessel, nor any deliberately caused damage, nor any damage caused by Clients’ lack of diligence.

It is strongly recommended that, upon booking, Client and all guests and/or passengers should contract adequate travel and health insurance packages for their travel arrangement.

Crew List / Client's Documents & Arrival Details

Upon request, including detailed instructions from AnnA Boat Charters, the Client must send a correctly filled Crew list, not later than 15 days prior to the first day of charter (7 days in case of Day Trip). The Client agrees that (s)he is the main contracting party of AnnA Boat Charters, and that Client is responsible for the other guests and/or passengers on board. Additionally, it is recommended to send an estimated time of arrival at least 15 days prior to the first day of charter, in order for the base staff to organize check-in procedure in as smooth way as possible. If Client has booked a transfer (e.g. from airport), then sending detailed arrival and departure information at least 15 days in advance is obligatory. Client is responsible for the accuracy of delivered crew list information, as well as for validity of all passports, visas, licenses and other identification documents.

If there is a change of guests/passengers during the charter, following charges are applicable:

  • an administration fee of €100 per person.
  • For Sailing Holidays:
    • upon request: new bed linen: €50 per cabin
    • upon request: new set of towels: €30 per set

In case the required information has not been provided in due time, AnnA Boat Charters has no responsibility for any possible delay that may occur either the on the 1st charter day and/or the 1st sailing day (typically the day after check-in).

Check-in & Check-out

Sailing Holidays:

  • Embarkation: Starting date, from 17:00
  • Disembarkation: Ending date, before 09:00
  • Obligatory return at the base the evening before the end of charter at 17:00 the latest.
  • Check in/out procedures time is considered part of the charter period.
  • In case the check-in procedures will be postponed for another day than the one already confirmed in the Charter Agreement, a surcharge is applicable. The surcharge will be half of a full charter day fee.

Day Trips:

  • Embarkation and disembarkation: According to the times indicated in the booking from for the respective excursion/cruise:
    • Motorboat excursions:
      • Morning: 9:00 – 13:00
      • Afternoon: 14:00 – 18:00
      • Full day: 10:00 – 18:00
      • Sunset: 19:00 – 22:00
    • Sailing catamaran day cruise: 10:00 – 18:00
  • Return to the base will be strictly on time to avoid delays of charters booked on the same day.
  • Check in/out procedures time is considered part of the charter period.
  • In case of late arrival there will be no compensation, neither financially nor by extending the return time of the charter.

Skipper & Hostess

AnnaA Boat Charters only offers skippered charters, even if you are an experienced sailor with sailing skills, this has advantages. Your sailing holidays will be more relaxing and you can benefit from the skipper’s local knowledge.

The skipper fee is always included in our price.

Hostess services are only applicable for holidays or cruises on our sailing catamaran.

  • In case of a Sailing Holiday a Hostess/Deckhand can be added at time of booking at extra cost – this should always be done for the full duration of the charter.
  • For Day Trips, a Hostess/Deckhand is mandatory and included in the price at time of booking

 

Role and Responsibilities of the Skipper

  • Navigation and Safety: The Skipper is responsible for safe navigation and operation of the vessel, including route planning, weather monitoring, and adherence to maritime laws.
  • Technical Expertise: The Skipper handles the vessel’s technical aspects, including engine checks and equipment maintenance.
  • Crew and Guest Coordination: The Skipper coordinates crew activities and ensures guests are briefed on safety procedures.
  • Local Knowledge: The Skipper provides insights into local attractions and customs.


Role and Responsibilities of the Hostess

  • Culinary Services: The Hostess prepares meals (limited to breakfast and light lunch) and snacks according to the Clients’ dietary requirements.
  • Deckhand Duties: The Hostess assists with deck operations, including docking, anchoring, and sail handling.
  • Guest Assistance: The Hostess assists guests with daily activities, provides local information, and helps with itinerary adjustments.


Client Requirements and Obligations

  • Provisioning and Meals: Clients are responsible for provisioning the yacht, including meals for the skipper and hostess, either on board or in restaurant on shore.
  • Accommodation: the Skipper will occupy one of the cabins on the vessel. In case hostess services have been booked, Skipper and Hostess will share a double cabin (Starboard rear cabin), reducing the number of available cabins to 3.
  • Respect and Communication: Clients are expected to treat the Skipper with respect and maintain open communication regarding daily plans and any changes to the itinerary.
    Similarly, Clients are expected to treat the Hostess with respect and maintain open communication regarding meal preferences and daily plans.
  • Compliance with Rules: Clients must comply with all safety instructions and maritime regulations as directed by the Skipper.
    Clients must comply with all instructions provided by the Hostess related to onboard etiquette and safety.
  • Insurance and Liability: Clients should have travel and personal liability insurance. Intentional damage caused by clients may result in additional charges.


Additional Considerations

  • Tipping the Skipper and Hostess is customary and appreciated, reflecting the level of service provided.
  • Feedback: Clients are encouraged to provide feedback on the Skipper’s and Hostess’s performance.
  • Special Requests: Clients should communicate any special requests or needs to the Skipper or Hostess in advance to ensure a tailored experience.

Other

Other than what was already stated in these terms, the Client shall also be liable:

  • to keep all areas on board clean
  • not to transport persons or goods for commercial purposes, or engage in any other commercial use of Vessel
  • to have aboard exact number of persons, and exact persons, as stated on the crew list,
  • to promptly inform AnnA Boat Charters about any possible changes in crew, guests or passengers,
  • to fully respect legal regulations of the host country,
  • not to participate in competitions and regattas without consent granted in written by the AnnA Boat Charters,
  • to undertake all safety precautions in order to keep the Vessel in good condition and avoid any damages or towing of the Vessel,
  • not to make excessive noise in marinas, harbours and other mooring locations,
  • to respect privacy and night-rest rights of occupants of the neighbouring vessels and houses,
  • not to engage with fishing or any other submarine activities without a valid license for such activities,
  • not to embark pets (dogs, cats, birds, etc.) aboard without prior written consent of AnnA Boat Charters

 

The Client warrants joint responsibility for all guests and passengers on-board. All consequences arising from the Client or its guests and passengers on board not respecting the above liabilities are the joint responsibility of the Client and guests/passengers on-board. In case of breach of the clauses above or other obligations of the Client and its guests/passengers based on these Terms, AnnA Boat Charters is entitled to remunerate from the Deposit in amount between €100 and the full Deposit, depending on the seriousness of the breach, and to claim indemnity for full incurred damage.

Alcohol and Drug Policy

Excessive use of alcohol on board will not be tolerated under any circumstances. The safety and enjoyment of all guests, passengers and crew members are our top priorities. Furthermore, the possession or use of any illegal drugs in any quantity is strictly prohibited. Violation of these policies may result in immediate termination of the charter without refund, and local authorities may be notified as required by law. Guests are expected to consume alcohol responsibly and to adhere to all applicable laws and regulations regarding alcohol and drug use.
